Some matters in copyright law are straightforward while others are subject to interpretation. In the library world, applying fair use to any particular situation, for instance, is often a gray area. Although you can apply the four factors set out in the U.S. Copyright Act to your situation at hand, it is ultimately up to a court of law to decide whether fair use applies or not. Copyright risk management is about determining how to deal with gray areas. In other words, is your enterprise ever willingto take any copyright risks? If so, in what circumstances?
