NextEra Energy has warned the US Supreme Court that the 303-mile, 2 Bcf/d Mountain Valley Pipeline could face a 15-month delay in completing construction if a district court ruling is allowed to stand undermining the US Army Corps of Engineers’ nationwide permit 12, a key water crossing permit. NextEra’s friend of the court filing June 26 came as multiple oil and gas industry groups have supported the Army Corps’ effort convince US Supreme Court to grant a stay pending appeal in the 9th Circuit of the nationwide injunction by US District Court for the District of Montana.
