In R (on the application of Samuel Smith Old Brewery) v North Yorkshire CC [2020] the Supreme Court has reversed the previous Court of Appeal decision and held that the planning officer had correctly understood the meaning of 'openness' when recommending approval of a planning application for the extension to a limestone quarry and confirms that visual impact is not a necessary part of such an assessment.
