Association of Washington Business v. Washington State Department of Ecology, 455 P.3d 1126 (Wash. 2020), involved the attempted regulation of oil and gas distributors, producers, and importers for the greenhouse gas emissions that their products ultimately emit when consumed. In 2016, the Washington State Department of Ecology (DOE), pursuant to the Washington Clean Air Act, Wash. Rev. Code ch. 70.94, promulgated a rule (Rule) creating greenhouse gas emissions standards for three types of businesses: (1) certain stationary sources, (2) petroleum product producers and importers, and (3) natural gas distributors. 455 P.3d at 1129; see Wash.
