TransCanada Steps Back From Eminent Domain Actions and Will Submit to New Nebraska Regulatory Process To Win Approval of Keystone XL Pipeline Project

On September 29 TransCanada Corp. announced that the company will pull out of the lawsuit filed by over 100 Nebraska landowners challenging their right to use eminent domain to seize land for the Keystone XL pipeline. Facing mounting legal expenses and a likely loss in court, the company said it would instead go through the Nebraska Public Service Commission (PSC) review process it had originally hoped to avoid. That regulatory process will take at least a year, and probably would be stalled further if President Obama rejects the federal permit for the pipeline. Keystone XL is a 1,179-mile pipeline that TransCanada has long planned to build from Hardisty, Alberta to Steele City, Nebraska that will transport Canadian and U.S. Bakken oil to U.S. markets.
