The U.S. Court of Appeals for the Fourth Circuit on October 16, ordered a temporary stay of water- crossing permits for Mountain Valley Pipeline, which had been approved by FERC to resume construction along much of the route. After the U.S. Army Corps of Engineers reissued permits under the Nationwide Permit 12 program and FERC authorized construction to resume in early October, MVP was planning to begin construction. Environmental groups sought a stay from the Fourth Circuit, asserting that the Army Corps failed to adequately consider construction effects on the Roanoke logperch and the candy darter, and that the groups would be harmed if stream-crossing activities are allowed to resume.
