By now, it has become routine to most ILMA members — every meeting begins with ILMA General Counsel Jeff Letter's reminder that the Association's Board of Directors has adopted a policy of strict compliance with both the letter and the spirit of U.S. antitrust laws. As highlighted by a recent action taken by the Department of Justice (DOJ), it is important to keep those laws in mind during the day-to-day operations of your individual businesses. In April DOJ's Antitrust Division filed a complaint in the U.S. District Court in California, alleging that David Topkins had engaged in a combination and conspiracy to fix poster prices online. The complaint outlines that Topkins and his co-conspirators entered into an agreement to fix poster prices by agreeing to adopt specific pricing algorithms for certain posters sold on the Amazon Marketplace. Topkins subsequently pleaded guilty to the charge.
