Sens. Al Franken (D-Minn.) and Chris Murphy (D-Conn.) recently introduced legislation known as the Mobility and Opportunity for Vulnerable Employees Act (MOVE Act). The bill seeks to significantly reduce an employer's ability to enter into non-compete agreements with lower-paid workers. The legislation was introduced with additional co-sponsors Sens. Elizabeth Warren (D-Mass.) and Richard Blumenthal (D-Conn.) in response to reports and court cases regarding the use of non-competes for lower-paid employees. If the bill is ultimately passed into law, many ILMA members might have to revisit their own non-compete agreements, and the manner in which they generally try to safeguard proprietary information.
