'Innocent Landowner'Defense Under Oil Pollution Act

The U.S.Coast Guard recently issued a final rule establishing standards and practices related to the"all appropriate inquiries"element of the innocent landowner defense under the Oil Pollution Act of 1990(OPA 90).This liability defense is used by owners and operators when their facility is the source of a discharge or is a substantial threat of a discharge of oil into navigable U.S.waters,adjoining shorelines or an exclusive economic zone.
