Kinder Morgan has avoided a feared six-month construction delay and USD 135 million cost increase on its Permian Highway Pipeline (PHP) project after a Texas court dismissed an application by a coalition of Texan cities, towns and landowners seeking to temporarily block construction of the gas pipeline. US district judge Robert Pitman quashed the application for a temporary restraining order (TRO) late last week, stating that the plaintiffs failed to prove that endangered Golden-cheeked Warblers – a species of bird – would suffer “irreparable harm” if the project proceeds.
