EPA asks DC court to throw out effluent suit

The US Environmental Protection Agency (EPA) has asked the US District Court for the District of Columbia to dismiss a lawsuit over its stay on power plant wastewater rules, saying environmental groups' concerns are no longer relevant. The agency said yesterday that environmental groups' arguments are now moot because the EPA replaced its stay on effluent limitations regulations earlier this month with a new rule. That effectively ended the stay on the original rule that the agency put in place in April.
