Washington—A California appeals court has ruled that the state’s Low Carbon Fuel Standard can stand for now, even though the state’s Air Resources Board did not follow proper procedure in implementing it. California’s 5th District Court of Appeals in Fresno ordered the Air Resources Board to make some technical tweaks and allow public comment on the law, but said the state can continue implementing the first-of-its-kind LCFS in order to avoid any adverse environmental impacts.
