US CFTC approves end-user exemptions for energy companies

Washington-The US Commodity Futures Trad- ing Commission December 9 approved a pro- posal to exempt certain end-users, including energy companies, from new mandatory swaps clearing requirements within the finan- cial reform law. The proposed end-user exception, which the commissioners approved by a 3-2 vote, would allow a swap deal to avoid the new clearing requirement under the law if at least one party to the transaction is not a financial entity and is using the swap to hedge com- mercial risk.
