Brazilian antitrust body Cade has won a federal court decision against CVRD, upholding Cade's 2005 decision that CVRD must either sell off its iron ore subsidiary Ferteco or relinquish its rights to CSN's Casa de Pedra iron ore in order to avoid holding a monopoly in Brazil. CVRD said in a statement that it is analysing how to defend itself legally against the new ruling. According to CVRD lawyer Pedro Gordilho, quoted in Valor Economico newspaper, the new decision is not final "because we can still appeal against it in the Supreme Court of Justice. It is therefore necessary to await further judgments in order to have a certain outcome to the case." Following CVRD's purchases of five iron ore miners, including Socoimex, Ferteco and Caemi, in the early 2000s, in August 2005 Cade gave CVRD 30 days either to sell off Ferteco or relinquish its rights of first preference on ore produced by Casa de Pedra over and above CSN's own needs. Otherwise CVRD would be considered to be holding an unacceptable monopoly on iron ore production in Brazil, the anti-trust body argued.
