Federal court case over 'fortified' 7Up settled out of court

The Dr Pepper Snapple Group and a California man have settled a lawsuit over labeling claims on 7Up products that were fortified with vitamin E. In the settlement, announced Monday, all parties agree to drop the case and pledge not to re-file the same arguments in the future. David Green, a Sherman Oaks, Calif" resident, and New York City-based consumer protection firm Reese Richman LLP filed the lawsuit in the U.S. District Court for the Central District of California, in Los Angeles, in November, arguing that adding fruit juice and vitamin E to carbonated beverages and making labeling claims that the products contained antioxidants was a violation of FDA policies.
