Court rejects FDA plea for two more years to propose FSMA food defense rule

Afederal judge Tuesday slapped down FDA's request that the agency be allowed an additional two years to write an intentional adulteration rule, and, once again, FDA is ordered to issue all seven final FDA Food Safety Modernization Act (FSMA) rules by June 30, 2015. On April 22, Judge Phyllis Hamilton of the U.S. District Court for the Northern District of California, Oakland Division, sided with the Center for Food Safety (CFS) and the Center for Environmental Health (CEH) and found FDA failed to promulgate FSMA regulations by the statutory deadlines (see FCN April 26, 2013, Page 1).
