Appeals court remands GenOn lawsuit

The Clean Air Act does not pre-empt state-level claims brought by property owners against a source of pollution, a federal appeals court said in a ruling regarding GenOn Power Midwest's coal-fired Cheswick Generating Station. The Philadelphia-based US Third Circuit Court of Appeals yesterday remanded to a lower court its ruling, keeping alive the class-action suit brought by 1,500 residents against the 570MW plant in Springdale, Pennsylvania.
