The Environmental Protection Agency no longer needs to consider potential dangers to endangered species before giving Clean Water Act (CWA) permitting authority to states,the U.S.Supreme Court ruled this week in a controversial 5-4 decision.In reversing an appeals court ruling,the high court said EPA is not obliged to consult with other agencies under the Endangered Species Act before turning water-permitting power over to states.Under CWA,EPA is required to give permitting power to states that meet nine specific criteria.
