THE HEALTH and Safety (Offences) Act 2008, which came into force in January, increases penalties and provides courts with greater sentencing powers for those who break health and safety law. This legislation doesn't mean that personal liability has increased for health and safety advisers. The new law simply brings penalties more into line with the 21st century. The previous penalties were set in 1974 as part of the Health and Safety at Work Act (HSW Act), and didn't necessarily offer a suitable deterrent any more.
