Common sense has prevailed in the judgment of the Inner House of the Court of Session in a Scottish case where the court was asked to con-siderwhetheran employer should be held liable where an employee has been injured as a result of an everyday hazard. In the case of Tracey Kennedy v Cordia (Services) LLP, Ms Kennedy, a home carer, claimed compensation from her employer after she fell on an icy path while making a care visit.
