LAST month, we noted that contractors can pose extra risks to you (as a client) because they may not know all the hazards or precautions associated with a given job, and other hazards and emergency measures at your workplace (www.healthandsafety-atwork.com/hsw/choosing-wisely ). When you take on a contractor, your legal duties extend to taking reasonably practicable steps to ensuring they can work in safety and that others (such as your employees) are not harmed by their work. The general duty is set out in Section 3.1 of the Health and Safety at Work Act, which says that every employer must conduct their undertaking "in such a way as to ensure, so far as is reasonably practicable, that persons not in his employment who may be affected thereby are not thereby exposed to risks to their health or safety".
