THE NEW offence of corporate manslaughter, or corporate homicide as it is called in Scotland, has featured on the legal landscape since the Law Commission's proposals of 1996, but was only finally ratified in the Corporate Manslaughter and Corporate Homicide Act 2007. This is a difficult area, because workplace deaths occupy an ambiguous position in the context of criminality. While some believe that corporate manslaughter is outside the sphere of mainstream crime, others consider it akin to murder. Nobody would argue that employers set out to kill or maim their employees, so the matter comes down to whether or not negligent behaviour is equivalent to criminality.
