Chinese patent prosecution and invalidation proceedings have unique requirements and features. As a result, patent specifications and claims otherwise suitable for foreign patent prosecution and invalidation proceedings may encounter insurmountable barriers in China. The following describes issues the practitioner should consider when drafting patent specifications and claims which may be the subjects of patent prosecution and invalidation proceedings in China.
