Australian Court Holds Use of Photographs By Book Publisher Infringed Copyright

The Federal Court of Australia has found that publishing house, Allen & Unwin Pty Limited, infringed the copyright of the relatives of the subject of its biography when it reproduced five photographs in the book "Sins of the Father". While in this case, the court did not award monetary damages for moral rights infringement, it did award additional damages of AU$45,000 (US$41,000) for copyright infringement after finding that the publisher respondent acted "in flagrant disregard of the rights of the applicants as owners of copyright" and had taken a "calculated risk".
