English Court of Appeal Stays Injunctive Relief Despite Finding of Patent Infringement

The English Court of Appeal has issued a further judgment in the ongoing litigation between medical product manufacturers Smith & Nephew and ConvaTec. Following on from its ruling1 in ConvaTec's favor on the construction of its numerically defined patent claim, the court has, by a decision handed down on July 30,2 now refused Smith & Nephew permission to appeal to the Supreme Court.
