Weeks after barring EPA and the Justice Department from using supplemental environmental projects (SEPs) in civil settlements, Jeffrey Clark, the Justice Department's (DOJ) environment chief, says he is now weighing whether he can also prohibit their use in citizen enforcement suits, while also suggesting he may seek to limit the suits themselves. "I think that it shouldn't come as any surprise that this is connected in some way to citizen suits," Clark, who leads DOJ's Environment & Natural Resources Division, told a March 27 Federalist Society call to discuss the new SEP ban. "So, I am starting to look at how citizen suits fit into that equation."
