Environmentalists are urging a federal appeals court to uphold their district court victory finding the Tennessee Valley Authority (TVA) liable under the the Clean Water Act (CWA) for coal ash leaks at a Tennessee impoundment, saying a recent related ruling bolsters the decision and that it is the only reasonable reading of the water law.In a March 15 brief, the Tennessee Clean Water Network (TCWN) and Tennessee Scenic Rivers Association say TVA is wrong in its appeal of the decision to claim that a district judge "rewrote the statute" by holding the corporate federal agency liable for pollution that leaked from its Gallatin, TN, ash impoundments into groundwater, and then to surface waters subject to CWA protections.
