The Supreme Court has let stand an appellate decision that allowed Flint, MI, residents' tort claims related to the city's lead in drinking water crisis to proceed, clearing the way for the tort suits to proceed though the decision means the court will not be clarifying the issue of whether the Safe Drinking Water Act (SDWA) precludes civil rights tort claims.In an order list released March 19, the court without comment declined to review a set of three cases from the U.S. Court of Appeals for the 6th Circuit that had allowed Flint residents to sue state and local officials for exposing them to lead-contaminated drinking water.
