A year or so ago a leading training provider was encouraging attendance at courses relating to CDM for Designers as a means of 'avoiding jail'. This unfortunate statement perpetuated a common misperception that custodial sentences were available for failing to comply with safety regulations. In fact, until now, custodial sentences were not available for any offence under construction safety regulations, and even for prosecutions under the Health and Safety at Work Act they have only been available in very limited circumstances.
