Liability for damage caused by 'escape of fire'

The Court of Appeal has carried out an extensive review of liability for damage caused by 'the escape of fire' from premises, but it declined to widen the rules of strict liability. Serious pollution incidents often give rise to compensation claims by those who have suffered damage or loss. A major question fac ing any legal system is whether liability requires some degree of fault, or whether just the fact of carrying out a potentially danger ous operation is sufficient to impose liability.
