The FCC is urging the U.S. Court of Appeals for the District of Columbia Circuit to reject Council Tree Communications, Inc.'s challenge of the "designated entity" (DE) rules the FCC used in last year's 700 megahertz band auction. In a brief filed Feb. 17, the Commission argued that Council Tree's appeal should be dismissed as untimely because it attempts to challenge an April 2007 order in which the decision was made to apply the DE rules used in the 2006 advanced wireless services (AWS) auction to the 700 MHz band sale. The issue was never reopened in a subsequent order being challenged by Council Tree, the agency said.
