N.Y. AG ASKS FEDERAL JUDGE TO THROW OUT DOJ MERGER DECREES

N.Y. Attorney Gen. Eliot Spitzer (D) urged a federal judge to reject DoJ consent decrees that cleared the way for the Verizon-MCI and AT&T-SBC mergers last year. Spitzer filed the comments Sept. 5 with U.S. Dist. Judge Emmet Sullivan, who抯 reviewing DoJ抯 actions under the Tunney Act. The consent decrees offered 搉arrow remedies [that] are wholly inadequate,?Spitzer said. 揟he court should find that DoJ and the merging parties... have not shown that the proposed mergers are in the public interest.?Sullivan抯 rejection of the consent decrees probably wouldn抰 undo the mergers, experts have said, but could lead to stricter conditions for future deals.
