But Bracewell & Giuliani partner Lisa Jaeger, who focuses on environmental law, said the errors — if substantiated — may not be enough to convince the ncourt to stay the rule. The rulemaking process, she said, affords the EPA with a "fair amount of latitude" in making errors. She added that "quite often" the nEPA's final rules have errors even after they have gone into effect, in which case the agency has the option of issuing a technical amendment.
