摘要

More than 500 plaintiffs have launched a second case against RINA over the sinking of Egyptian ferry Al-Salam Boccaccio 98 in 2006 after it experienced a fire in the car deck. This time, plaintiffs will also sue RINA's holding company, Ente Registro Italiano Navale. The first case was dismissed by the Genoa Court, which upheld the doctrine of 'state immunity'. This is because RINA was acting as a Recognised Organisation for the ferry's flag state, Panama, and therefore Italy lacks jurisdiction on RINA. Lawyers for the plaintiffs argued in vain against state immunity on the basis that RINA also had a commercial contract with the ferry's owner, El Salam Maritime Transport, owned by Mamdouh Ismail. However, Ente Registro Italiano Navale is Italian, and it accepted Italian jurisdiction in the first hearing on 15 January.
