Für kommunale Baulastträger bieten Aufgrabungen durch Versorger und andere Leitungsträger großes Konfliktpotenzial. Die Straßenbauverwaltungen sind verantwortlich für die Wahrnehmung der Verkehrssicherungspflicht und für den Werterhalt der Straße, haben jedoch keinen direkten Einfluss darauf, wer, mit welcher technischen Ausstattung und mit welcher Qualifikation die Arbeiten zur Wiederherstellung des Straßenaufbaus ausführt. In den Straßengesetzen der Länder wird lediglich darauf verwiesen, dass Aufgrabungen Sondemutzungen sind und dass nach einer Sondernutzung der... die Straße in einem ... Zustand dem Baulastträger wieder zu übergeben hat. Um den Verwaltungen ein Werkzeug zur Hand zu geben, hat die FGSV die Zusätzlichen Technischen Vertragsbedingungen und Richtlinien für Aufgrabungen in Verkehrsflächen (ZTV A-StB) herausgegeben. Diese greifen jedoch zu kurz, da die Verwaltungen im dafür relevanten Bauvertrag kein Vertragspartner sind. Die Senatsverwaltung für Berlin hat daher ergänzend zu den ZTV A-StB „Verbindliche Regelungen für die endgültige Wiederherstellung von Fahrbahnen, Geh- und Radwegen nach Aufgrabungen" erarbeitet und 2014 per Ausführungsvorschrift eingeführt.
