Following a decision by the High Court on July 31 not to grant an injunction against RMT, which began industrial action at East Midlands Trains on July 20 (RBI442 p8), EMT was due to appeal this decision at the Court of Appeal on August 13. EMT had applied for the injunction after the union instructed its members not to work overtime and work to rule from July 20, coinciding with the start of a major engineering blockade at Nottingham. The TOC believes that RMT is pursuing 'unlawful strike action', going beyond its ballot mandate for action short of a strike.
