Supreme Court denies states' appeal over MATS

The Supreme Court on Monday declined to hear a case that could havernthrown into question the continued implementation of an air qualityrnrule limiting mercury, arsenic and acid gas emissions by coal- and oilfiredrnpower plants.rnThe high court last June found that the Environmental ProtectionrnAgency had been remiss in not taking into account the costs obligatedrnto utilities for implementation of its Mercury and Air Toxics Standardsrn(Michigan, et al v. EPA, 15-1152). EPA was instructed to analyze the rule'srncosts, but the rule itself was not vacated.
