Over the past two decades, the construction industry at every level continues to see frequent litigation on projects, including those in the gas and pipeline industry. Often, project owners try to minimize their own risk by passing ever more contractual risk on to the contractor, which many contractors can't (or won't) take on.rnOther owners, however, have learned to very successfully use what's known as "partnering" as a risk-management tool. Partnering has been used quite heavily by many state and federal agencies in the last 10 years and for several high-profile projects, such as the construction of the new Second Avenue subway tunnel in Manhattan and the Central Artery in Boston.Many contracting authorities have drifted in and out of using partnering on projects, claiming a range of successes. Partnering encourages some contractors, for instance, to include fewer contingencies in their bid since they have a greater understanding of the owner's position and the project's needs and requirements.
