Insurer seeks trustee for reopened Fifth Dimension bankruptcy to avoid avoid joint and several liability

Century Indemnity Company moved on April 8 for appointment of a Chapter 7 trustee in the case of Fifth Dimension Inc. in order to consummate a settlement that was made to avoid joint and several liability with respect to two contaminated sites in Somerset County, New Jersey. The case is in federal court for the District of New Jersey. (See issue of July 30,2010 P. 8.) Century says, "On July 14,2010, this court entered an order granting the motion to reopen. In order to consummate the settlement, a Chapter 7 trustee must be appointed to, inter alia, represent the interests of Fifth Dimension's bankruptcy estate and to execute the various settlement documents on behalf of the bankruptcy estate."
