NL Industries says RCRA, CWA do not allow citizens groups to sue where an agency remediation is pending

In support of summary judgment, NL Industies Inc. (NL) and NL Environmental Management Services Inc.'s (EMS) contended on Oct. 1 that the Resource Conservation and Recovery Act and the Clean Water Act do not permit citizens groups to challenge an "actively involved" agency in remediation of a site that is the alleged source of sediment in the Raritan River in Sayreville, New Jersey.
