Judge finds RCRA and CWA allow citizens suit against NL Industries and others despite remedial work at site

U.S. Judge Joel A. Pisano of the District of New Jersey held on Jan. 8 that the Resource Conservation and Recovery Act and the Clean Water Act allow Raritan Baykeeper Inc. to bring a citizens suit against NL Industries Inc. and others with respect to the source of sediment in the Raritan River in Sayreville, New Jersey.
