The U.S. Environmental Protection Agency contended on June 28 that American Farm Bureau Federation and Pennsylvania Farm Bureau lack subject matter jurisdiction because they have not shown that their failure to timely demonstrate standing is excusable in seeking an order vacating the Final Chesapeake Bay Total Maximum Daily Load (TMDL) for nitrogen, phosphorus and sediment.
