The U.S. Environmental Protection Agency contended on March 17 that American Farm Bureau Federation and Pennsylvania Farm Bureau have failed to demonstrate standing to seek an order vacating the Final Chesapeake Bay Total Maximum Daily Load for nitrogen, phosphorus and sediment. The case in federal court for the Middle District of Pennsylvania. (See issue of Jan. 30,2012 P. 8.) The EPA says, "Plaintiffs in this matter, associations of various agribusinesses and homebuilders, allege standing to sue on behalf of their members Such an association 'has standing to bring suit on behalf of its members when: (a) its members would otherwise have standing to sue in their own right; (b) the interests it seeks to protect are germane to the organization's purpose; and (c) neither the claim asserted nor the relief requested requires the participation of individual members in the lawsuit.'
