Getty in dispute over ethanol sales agreement

BioEnergy International, which operates a Pennsylvania ethanol plant, is involved in an arbitration dispute with Getty Petroleum Marketing over a five-year sales agreement. A BioEnergy subsidiary operates a 110 million gals/yr ethanol plant in Clearfield, Pa.rnAccording to BioEnergy exec Sam McConnell, the company signed a five-year contract which committed Getty to buy most of the plant's output under a formula-based price. Just over two months into the contract, Getty allegedly breached the contract, filing an arbitration claim "disputing the validity of our formula-based contract." Since filing the arbitration claim, Getty has been paying Bionol, but at a lower rate, he said.
