Industry Scores Again in Hot Fuels Litigation

Plaintiffs' lawyers in the more than seven-year-old, multistate "hot fuels" litigation have dismissed claims against 15 of the defendants. The Feb. 6 development is the third in a series of victories for the industry in the massive class action litigation, which spans more than 20 states and claims that majors, oil marketers and retailers cheated motorists by retailing fuel by the gallon without compensating for changes in temperature. While this represents a significant win, there are still cases pending, and the industry won't have closure until they're resolved, a legal expert says. More than two dozen defendants have settled, at least 15 as late as December.
