The Employment Appeal Tribunal (EAT) has found in Lothian and Borders Police v dimming that a special constable who was turned down in her application to become a regular constable on grounds of her eyesight disorder was not protected under the Disability Discrimination Act 1995 (DDA). The finding that career progression was not a 'day-to-day activity' is questionable, however, and the EAT's decision to overturn the finding of the employment tribunal has done nothing to clarify the law in this area.
