Statements on fitness for work rarely constitute personal sensitive information and the report should be issued, argues Jacques Tamin.rnFew occupational physicians, if any, would disagree with the Faculty of Occupational Medicine (FOM) view that worker consent must be obtained before an OH consultation can proceed. For that consent to be valid, the worker needs to understand the purpose and possible outcomes of the consultation. The physician will normally send their opinion to the manager in a report. If the worker disagrees with that opinion, should they be allowed a second bite at the cherry? Does the employee have a right to withdraw consent for the report to be sent to the employer?
