Lawsuit filed over proposed spent fuel shipments

Former Idaho governor Cecil Andrus is suing the Department of Energy in an effort to force it to release information related to the proposed shipment of commercial spent nuclear fuel to Idaho National Laboratory. The environmental group Advocates for the West filed the lawsuit on behalf of Andrus in the U.S. District Court for the District of Idaho on September 29. The suit claims that the DOE violated the Freedom of Information Act (FOIA) by improperly withholding and failing to disclose information and documents related to the DOE's proposed waiver of a 1995 agreement with the state to remove nuclear waste from INL. Known as the Batt Agreement, after former governor Phil Batt, the agreement also prohibits the shipment of commercial spent fuel to INL.
