Care Act will bring legal challenges, councils are warned

A local government lawyer has warned that councils could be exposed to legal challenges when the Care Act comes into force next month. Privately, some adult social care directors expect there to be varying practice and adherence to the law across the country. Some fear legal challenges, which could leave local government picking up expensive legal bills. Olwen Dutton, of law firm Bevan Brittan, told The MJ: 'It has come in very fast. A lot of people are concerned they are not ready. A lot of authorities are still in the process of developing and consulting. 'We do know that there have been frequent challenges in the past to the way that authorities have applied adult social care legislation. 'Councils need to move very quickly and consider carefully what their priorities are in terms of any new policies they need to implement. A number of authorities are going to still be catching up after the Act is implemented.'
