Renegotiation of S106 unnecessary, says LGA

Government plans to help developers renegotiate Section 106 deals signed prior to April 2010, were this week branded 'unreasonable' and 'unnecessary' by the Local Government Association (LGA). Developers must currently wait five years to request renegotiation talks with councils over Section 106 deals - which commit developers to community investments as part of their planning permission - if a voluntary agreement cannot be reached. But the DCLG has proposed that deals made before 6 April 2010 should not be subject to the waiting period. The move forms part of the Government's plans to kick-start stalled developments.
